1. About Us
Irys is a software service operated by Whytewood Creative Ltd, a company registered in England and Wales (Company No. 16197906), trading as Irys.
By accessing or using our platform, you agree to be bound by these Terms. If you do not agree, you must not use our services.
2. Our Services
Irys provides software services to business customers. The specific services delivered are agreed directly with each customer. These Terms govern your use of those services.
Irys does not provide legal advice and is not a regulated legal service provider.
3. Customer Obligations
Customers are responsible for:
- Ensuring their use of Irys complies with all applicable laws and regulations
- Maintaining the accuracy of any data provided to the platform
- Obtaining any necessary consents from their own end users prior to using Irys to communicate with them
- Appropriate supervision of any automated outputs generated by the platform
4. Data & Privacy
Where Irys processes personal data on behalf of a customer, the customer acts as the Data Controller and Whytewood Creative Ltd acts as a Data Processor, processing data only on the customer's documented instructions and in accordance with applicable data protection law, including the UK GDPR and Data Protection Act 2018.
Irys implements appropriate technical and organisational measures to protect personal data. In the event of a personal data breach, affected customers will be notified in accordance with applicable legal timescales.

5. Third-Party Services
Irys integrates with and relies upon third-party platforms to deliver its services. Availability and performance of those platforms is outside our control. We will notify customers of any material changes that affect service delivery.
6. Fees
Fees for use of Irys are agreed with each customer individually. Payment terms are set out in the relevant customer agreement. Whytewood Creative Ltd reserves the right to amend fees with not less than 30 days' written notice. All fees are exclusive of VAT unless otherwise stated.
7. Limitation of Liability
To the fullest extent permitted by law, Irys is provided on an "as is" basis. Whytewood Creative Ltd shall not be liable for any indirect, consequential, or incidental loss arising from use of the platform. Our aggregate liability in any 12-month period shall not exceed the total fees paid by the customer during that period. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence.
8. Termination
Either party may terminate their agreement with 30 days' written notice. Whytewood Creative Ltd may terminate immediately in the event of material breach, non-payment, or conduct that violates applicable law.
9. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Whytewood Creative Ltd reserves the right to update these Terms. The current version is always published at askirys.co/terms. Continued use of the platform following any update constitutes acceptance of the revised Terms.
